Dear Prime Minister Vejjajiva

I am writing on behalf of the Federation of Korean Seafarers’ Unions affiliated with International Transport Workers’ Federation, which represents over five million union members in the transport industry worldwide, to express my very serious concern about the summons recently issued by Thai police against trade union leaders and PAD supporters. It appears the charges are made in relation to the non-violent airport occupations and closures that occurred last year.
I understand these charges include invasion and destruction of property, inciting unrest and additionally of terrorism – a charge that carries the death penalty. Such charges are grossly exaggerated. According to reliable reports, no physical damage was caused by the airport occupations and the only violence was the throwing of a grenade – not by PAD supporters, but by supporters of Thaksin Shinawatra.
From the information I have received, police have acted against a number of trade union leaders and 30 leading members of the People’s Alliance for Democracy (PAD) on these charges. Many of the union leaders summonsed are from ITF affiliated-organisations. They are Bro. Somsak Kosaisook (former president and present advisor of the State Railway Workers Union of Thailand), Bro Sawit Kaewwarn (President of the State Railway Workers Union of Thailand) Sis. Chamsri Sukchotirat (President of Thai Airways International Union) and Bro. Sirichai Mai-ngam (President of the Electricity Generating Authority State Enterprise Workers’ Union).
The FKSU and ITF fully supports the rights of its members to engage in legitimate and peaceful protest action and would strongly urge you to intervene to quash these shocking allegations and withdraw the charges made.
I am sure that you agree with me, Prime Minister Vejjajiva, not only that these charges are disproportionate in nature, but also that a priority of any government must be to foster positive industrial relations.
I would be very grateful to withdraw the charges made.

ผมเขียนจดหมายฉบับนี้ถึงท่านในนามของ สหพันธ์สหภาพแรงงานลูกเรือเดินทะเลแห่งประเทศเกาหลี ซึ่งเป็น สมาชิกของสหพันธ์แรงงานขนส่งระหว่างประเทศ (ITF) ที่มีสมาชิกมากกว่า 5 ล้านคน ใน อุตสาหกรรมการขนส่ง ทั่วโลก, เพื่อที่จะแสดงความห่วงใยเป็นอย่างยิ่งต่อการออกหมายเรียก โดยทางตำรวจไทยต่อผู้นำสหภาพแรงงาน และกลุ่มผู้สนับสนุนของพันธมิตรประชาชนเพื่อประชาธิปไตยเมื่อไม่นานนี้ ซึ่งปรากฏให้เห็นถึงข้อกล่าวหาที่ เชื่อมโยงกับเหตุการณ์การชุมนุมอย่างสงบปราศจากความรุนแรง และการปิดสนามบินที่เกิดขึ้นเมื่อปีที่ผ่านมา
ผมเข้าใจว่าข้อกล่าวหาต่างๆเหล่านี้รวมถึง “มั่วสุมกันตั้งแต่ 10 คนขึ้นไปกระทำการใดๆเพื่อให้เกิดการเปลี่ยนแปลง ในกฎหมายแผ่นดิน เพื่อให้เกิดความปั่นป่วนหรือกระด้างกระเดื่องในหมู่ประชาชน ถึงขนาดที่จะก่อความไม่สงบขึ้น ในราชอาณาจักรและบุกรุกสำนักงานในความครอบครองของผู้อื่น กระทำการใดเพื่อให้เกิดความปั่นป่วนหรือ กระด้างกระเดื่องในหมู่ประชาชน รวมทั้งข้อหา “ก่อการร้าย”–ซึ่งเป็นข้อหาที่มีโทษสูงสุดถึงประหารชีวิตและซึ่งเป็น ข้อกล่าวหาที่รุนแรงเกินความเป็นจริง
จากแหล่งข่าวที่เชื่อถือได้รายงานว่า ไม่มีความเสียหายใดๆทางกายภาพที่เกิดขึ้นจากการชุมนุมที่สนามบินทั้งสอง แห่ง มีเพียงแต่ความรุนแรงที่เกิดขึ้นจากการปาระเบิดเข้าไปในที่ชุมนุม–ซึ่งไม่ได้กระทำโดยกลุ่มผู้สนับสนุน พันธมิตร แต่เป็นฝีมือของกลุ่มผู้ที่สนับสนุนทักษิณ ชินวัตร
จากข้อมูลที่ผมได้รับ ตำรวจได้ดำเนินคดีในข้อหาเหล่านี้ต่อผู้นำสหภาพแรงงานจำนวนหนึ่งและ แกนนำของ พันธมิตรประชาชนเพื่อประชาธิปไตยอีก 30 คน ผู้นำสหภาพแรงานหลายท่านที่ถูกออกหมายเรียก ในข้อหาเหล่านี้ มาจากสหภาพแรงงานที่เป็นสมาชิกของสหพันธ์แรงงานขนส่งระหว่างประเทศ(ITF) ซึ่งได้แก่นายสมศักดิ์ โกศัยสุข (อดีตประธานและปัจจุบันเป็นที่ปรึกษาของสหภาพแรงงานรัฐวิสาหกิจรถไฟแห่งประเทศไทย) นายสาวิทย์- แก้วหวาน (ประธานสหภาพแรงงานรัฐวิสาหกิจรถไฟแห่งประเทศไทย) นางแจ่มศรี สุกโชติรัตน์ (ประธานสหภาพ แรงงานรัฐวิสาหกิจการบินไทย) รวมถึง นายศิริชัย ไม้งาม (ประธานสหภาพแรงงานรัฐวิสาหกิจการไฟฟ้าฝ่ายผลิต แห่ง ประเทศไทย)
สหพันธ์แรงงานขนส่งระหว่างประเทศ (ITF) ขอสนับสนุนสิทธิของสมาชิก ในการที่จะประท้วงโดยสันติและชอบ ด้วยกฎหมายอย่างเต็มที่และขอเรียกร้องให้ท่านเข้าไปดำเนินการและทำการเพิกถอนข้อกล่าวหาที่เลวร้ายและน่า ตกใจเหล่านี้ รวมทั้งถอนข้อกล่าวหาทั้งหมด
ผมมั่นใจว่าตัวท่านเองก็เห็นด้วยกับผม,ท่านนายกฯ อภิสิทธิ์,ว่าข้อกล่าวหาเหล่านั้นไม่เพียงแต่ไม่สมเหตุสมผลตาม ความเป็นจริงแล้ว อีกทั้งท่านยังต้องคำนึงถึงการสร้างแรงงานสัมพันธ์ที่ดีซึ่งเป็นสิ่งที่รัฐบาลทุกแห่งต้องให้ ความสำคัญอีกด้วย
ผมจะขอบคุณเป็นอย่างยิ่งถ้าได้รับการตอบรับจากท่านในเรื่องนี้
